Applicability.
This regulation applies to the Active Army, the Army National Guard of the United States and the United States Army Reserve unless otherwise stated. The provisions of Title 12 United States Code 3401 et seq., do not govern obtaining access to financial records maintained by financial institutions located outside of the territories of the United States, Puerto Rico, the District of Columbia, Guam, American Samoa, or the Virgin Islands. The procedures out-lined in paragraph 2-4d will be followed in seeking access to financial information from these facilities. This regulation also applies to financial records maintained by financial institutions as defined in the glossary.
Purpose
This regulation provides DA policies, procedures, and restrictions governing access to and disclosure of financial records maintained by financial institutions during the conduct of Army criminal investigations and law enforcement inquiries.
