Basis and purpose.
(a) Basis.
These rules are issued pursuant to the Communications Act of 1934, as amended.
(b) Purpose.
The purpose of these rules is to implement sections 251 and 252 of the Communications Act of 1934, as amended, 47 U.S.C. 251 and 252.
Applicability to negotiated agreements.
To the extent provided in section 252(e)(2)(A) of the Act, a state commission shall have authority to approve an interconnection agreement adopted by negotiation even if the terms of the agreement do not comply with the requirements of this part.
