Applicability.
This regulation applies to the Active Army, the Army National Guard/Army National Guard of the United States, and the U.S. Army Reserve unless otherwise stated. This regulation also applies to the Army National Guard/Army National Guard of the United States members on inactive duty training or active duty for training who are liable, as a result of a report of survey, for property issued by the United States to the Army National Guard/Army National Guard of the United States that is lost, damaged, or destroyed as of 30 September 1980. The debt must be under the control of the Department of the Army and have occurred while the member served on active duty, except the Army National Guard / Army National Guard of the United States as noted above. During mobilization, the proponent may modify chapters and policies contained in this regulation.
Purpose
This regulation gives instructions for submitting and processing applications for remission or cancellation of indebtedness to the U.S. Army. Applications must be based on injustice, hardship, or both. This includes debts caused by errors in pay to or on behalf of a Soldier (DOD 7000.14R, volume 7A, chapter 50, paragraph 5004). Waiver of erroneous payments of pay and allowances and travel or transportation may be considered under AR 37-104-4, chapter 32.
