APPLICABILITY AND SCOPE

This Instruction:

Applies to the Office of the Secretary of Defense, the Military Departments (including their Reserve components), the Office of the Chairman of the Joint Chiefs of Staff, the Combatant Commands, the Office of the Inspector General of the Department of Defense, the Defense Agencies, the DoD Field Activities, and all other organizational entities in the Department of Defense (hereafter referred to collectively as the "DoD Components").

Applies to all DoD real property holdings except:

Civil works projects.

The acquisition and management of defense industrial plants that are governed by DoD Directive 4275.5 (Reference (b)).

Does not apply to DoD real property holdings:

Disposed of pursuant to a base closure law, except for paragraphs 5.1.2., 5.5., 5.8., 5.9., 5.10., and 5.11., which do apply.

Outside the United States with regard to those provisions of law not having extraterritorial application. (See DoD Instruction 4165.69 (Reference (c))).

PURPOSE

This Instruction:

Implements policy and assigns responsibility pursuant to Reference (a) for the disposal of real property.

Re-delegates various statutory and regulatory authorities and responsibilities relating to real property disposal.
