This Standard applies to any party who needs to apply for a Concession (a planned or known non-compliance) against a Category 1 Standard requirement, or in the case of LU, any LU Directorate seeking a Concession against a Category 5 Standard requirement.
For discovered or introduced non compliance 1-642 (formerly 2-05304-012) Standard for Temporary Approved Non Compliance (TANC) shall be used. This is allowable through Clause 9.3(b) of the PPP Service Contract and applies to parties governed by the PPP Contract.
Purpose
The purpose of this Standard is to set out the requirements and process which all affected parties must follow when applying for and processing a Concession to a Category 1 or Category 5 Standard requirement.
Compliance with this Standard ensures that:
there is competent safety peer review within LU, Infracos and PFIs;
all affected parties have a right to apply for Concessions and have appropriate access to the process to do so;
the requirements on affected parties do not impose an undue burden or delay on those parties;
the merits of any proposal are properly and objectively assessed;
interactions with other Category 1 Standards, (Category 5 Standards for concessions applicable to LU only), Railway Group Standards and any other current / live authorised Concessions are identified and properly and objectively assessed;
The potential commercial impact is reviewed by the relevant LU PPP Contracts Team and is understood by the LU Responsible Manager, prior to making a decision on the concession request.
