scope:
Purpose.
This instruction provides policy and procedural guidance concerning the use of the legal authorities contained in Sections 2341-2350 of title 10, United States Code (reference a). It does not provide substantive legal authority to negotiate or conclude cross-servicing agreements. Such authority is provided in applicable US law (reference a) and may be delegated by the Secretary of Defense to the Chairman of the Joint Chiefs of Staff and the combatant commanders as described in Enclosures A and C. This instruction implements reference b.
Applicability.
This instruction applies to the Joint Staff, combatant commands, and Defense agencies reporting to the Secretary of Defense through the Chairman of the Joint Chiefs of Staff. These organizations will use this instruction, in conjunction with references b, c, and d, to exercise acquisitiononly authority and to negotiate, conclude, and execute cross-servicing agreements for which approval authority has been delegated to the Chairman by the Secretary of Defense. Military departments and Defense agencies negotiating and concluding implementing arrangements for cross-servicing agreements will coordinate such arrangements with the applicable combatant command in accordance with paragraph 5.5.3 of reference b.
