TRANSITIONAL COMPENSATION FOR ABUSED DEPENDENTS

Applicability and Scope.
This instruction applies to dependents of members of the Air Force, Air Force Reserve or Air National Guard, who have been on active duty (including as defined in 10 United States Code (U.S.C.), 12602 (b)(2)) for more than 30 days and who after 29 November 1993 are:
Separated from active duty under a court-martial sentence resulting from a dependent-abuse offense.
Administratively separated from active duty if the basis for separation includes a dependent-abuse offense; or
Sentenced to forfeiture of all pay and allowances by a court-martial which has convicted the member of a dependent-abuse offense.
Uniformed Services Former Spouse Protection Act. A former spouse or legally separated spouse may be entitled to a percentage of retirement pay designated by a court if the member had 20 plus years of active service even if the member was not eligible to receive the retirement pay:

If using e-mail to send Privacy Act Program or Personally Identifying Information (PII) with DoD, please review AFI 33-332, Air Force Privacy and Civil Liberties Program, Chapter 2. Sending Personal Information over Electronic Mail and Chapter 12, Disclosing Records to Third Parties and take appropriate action to protect this information prior to forwarding by e-mail.
An applicant cannot receive both the percentage of retirement pay and transitional compensation at the same time. If a spouse or former spouse is receiving transitional compensation payments and later is determined to be eligible for and receives payments under 10 U.S.C. 1408(h), any amounts of transitional compensation received must be recouped.
DFAS-CL/RPBFS will correspond directly with the applicant in lieu of the MPS.
