APPLICABILITY AND SCOPE

This Instruction applies to all DoD entities entering sharing agreements with the Department of Veterans Affairs (hereafter referred to collectively as the "DoD Components").

PURPOSE

Under the authority of DoD Directive 5136.1 (reference (a)), this Instruction:

Implements section 8111 of title 38, United States Code (U.S.C.) (reference (b)) and section 1104 of title 10 U.S.C. (reference (c)).

Implements policy, assigns responsibilities and prescribes procedures under the authority of references (b) and (c) for the development and operation of Department of Defense/Department of Veterans Affairs (DoD/VA) Health Care Resource Sharing Agreements (hereafter referred to as "sharing agreements") when a determination is made that resource sharing will improve access to quality health care or increase cost-effectiveness of the health care provided by the Military Health System (MHS) and the Veterans Health Administration (VHA) to beneficiaries of both Departments.

Establishes the DoD/VA Joint Executive Council (JEC) according to section 320 of reference (b) and the Health Executive Council (HEC).
