The provisions of this Memorandum of Arrangements are applicable to the Government Quality Assurance of Defence Materiel (which includes equipments, assemblies, sub-assemblies, components, semi-finished products and materials) procured for the Armed Forces and which is to be delivered or repaired by a contractor or for which he has to supply technical services and for which the Delegatee is normally competent to provide the Government Quality Assurance.

These arrangements are also applicable to sub-contracts including those placed with a Government Establishment, which are awarded by a contractor or sub-contractor in either the Federal Republic of Germany or the United Kingdom to a sub-contractor in the other country:

- which arise from contracts from the Government of one of the two countries

- which arise from contracts from a NATO member country or a non-NATO member country for which either the Federal Republic of Germany or the United Kingdom has undertaken Government Quality Assurance, provided that the permission of the Purchasing Country has been given.

These arrangements are not applicable to:

- Defence Materiel and Services which are ordered by the Government of either country from a Government Establishment in the other country.

- Defence Materiel and Services for which Government Quality Assurance cannot be carried out, by reason of the inadequacy of the available technical specifications, information or resources.

- the supply of documentation for the operation and maintenance of the Defence Materiel.
