This chapter contains provisions for the application, enforcement and administration of subsequent requirements of this code. In addition to establishing the scope of the code, Chapter 1 identifies which mechanical equipment, appliances and systems come under its purview. Sections M-101.0 and M-102.0 establish the scope and applicability of the code and address existing equipment and systems. Section M-103.0 addresses existing mechanical systems and the repair and maintenance thereof. Section M- 104.0 establishes the validity of the code and its relation to other laws, statutes and ordinances.
Sections M-105.0 and M-106.0 state the duties, rights and responsibilities of the code official and the mechanical inspection department.
Seclion M- 107.0 establishcs the approval authority of the code official and the mcchanical inspection department, including the right to make modifications to code provisions and to approve alternative materials and uscd materials.
Sections M-108.0 and M-109.0 deal with the administrative aspccts of code enforcernent relative to permit application and issuance. Sections M-i 10.0 and M-111.0 address the demolition and relocation of existing structures. Section M-112.0 sets forth the conditions of a permit relative to code compliance.
Section M- 11 3.0 addrcsses permit fees. Section M-114.0 addresses the required inspections, the procedures for such inspections, and the rights and responsibilities of the code officiai.
Section M-115.0 pertains to the execution of work as it may affect code compliance. Section M- i 16.0 establishes what constitutcs a violation of the code and what actions are to be taken by the code official and the violator.
Section M-117.0 establishcs the stop work order procedure. Section M- 11 8.0 sets forth the approval procedures upon completion or near completion of work.
Section M- 1 19.0 addresses the identification and abatement of unsafe existing conditions relative to mechanical equipment and systems. Section M-120.0 gives the code official the authority to vacate buildings under emergency conditions warranting such action.
Section M- 12 I .O provides the due process provisions of the code for building owners by establishing an appeals process that must be exhausted prior to civil action.
Purpose
A mechanical code cannot be effective without adequate provisions for its administration and enforcement. The official charged with the administration and enforcement of mcchanical regulations has a great responsibility, and with this responsibility goes authority. No matter how detailed the mechanical code may be, the code official must, to some extent, excrcise judgement in determining compliance with the code. The code official has the responsibility to ensure that the homes in which the citizens of the community reside and the buildings in which they work are designed and constructed to be reasonably free from hazards associated with the presence and utilimtion of mechanical equipment, appliances and systems. The code intends to establish a minimum acceptable level of safety.
