scope:
The contract for the building of a gas cleaning system under the terms of this guideline lays down obligations and warrants certain characteristics relating to the process, design, materials, operation and other matters, which are defined as integral to the achievement of proper operation. Some of these characteristics and obligations have to be demonstrated upon completion of the work during acceptance. Acceptance has legal consequences including the passage of risk, payability of remuneration by the client and the start of the warranty period. Within the liability period, the supplier is liable for compliance with the warranted characteristics in so far as he is held to be negligent. Before acceptance, the onus of proof for defect-free work lies with the contractor. Defects of title, e.g. the encumbrance of the work by third-party title claims, are not covered by this guideline.
