scope:
The technical qualification of Competent Persons refers to the work equipment and plants that require monitoring. In actual operational practice, the selection of the Competent Person according to § 3 para. 3 of the BetrSichV is oriented to the work equipment used or the type of plant that requires monitoring.
Requirements for Competent Persons are obtained from the BetrSichV (cf. § 2 para. 7). There may be additional requirements in, for example:
- German Labour Safety Act (Arbeitsschutzgesetz
, ArbSchG) - German Code on Equipment and Product Safety (Geräte- und
Produktsicherheitsge
setz, GPSG) or and the 9th and 12th bye-law to the GPSG - professional guild's rules and standards (e.g. BGV, BGR, BGI)
- Technical Rules for Operational Safety (Technischen Regeln für Betriebssicherheit, TRBS)
- Technical rules (for example, VDI guidelines, DIN standards, VDE specifications)
