APPLICABILITY.
This UFC applies to service elements and contractors involved in the planning, design and construction of DoD facilities worldwide. It is applicable to all methods of project delivery and levels of construction, but is not applicable to public-private ventures (PPV). All design and construction outside of the United States and United States territories is governed by international agreements, such as the Status of Forces Agreements (SOFA), Host Nation-Funded Construction Agreements (HNFA), and in some instances, Bilateral Infrastructure Agreements (BIA), and country-specific Final Environmental Governing Standards (FGS) or the DoD Overseas Environmental Baseline Guidance Document, DoD 4715.05G. The OEBGD applies when there are no FGSs in place. Therefore, in foreign countries this UFC will be used for DoD projects to the extent that it is allowed by and does not conflict with the applicable international agreements and the applicable FGS or OEBGD.
