This module applies to Network Rail land that is currently used for the operational railway. It defines the process for dealing with a notice from a Mine Owner informing Network Rail of the intention to work minerals lying under an area of protection.

NOTE: Throughout this document such a notice is referred to as a Notice of Approach (NOA).

This module does not apply to operational land that could be affected by oil and gas extraction.

This module does not include the process to be followed when a legal agreement is in place between Network Rail and a mine owner that replaces the provisions contained within the 1845 and 1923 Acts.

Purpose

The purpose of this module is to mitigate the risk of:

a) Uncontrolled ground movement caused by the withdrawal of support to the railway in connection mining operations; and

b) Unnecessary financial outlay associated with the mismanagement of a notice of approach.
