This Procedure is to be applied to all Works carried out under a Project Works Contract which provide New or Renewed Assets or remove existing assets which are, or are intended to be, maintained under a Maintenance Contract.
It shall also be applied to those Works which have the capacity to affect adjacent assets which are maintained under a Maintenance Contract. (a new thrust-bored culvert affecting stability of the track and cable runs for example).
It does not apply to any Works which do not have a bearing on a Maintenance Contract. It does not apply to the transfer of responsibilities from outgoing to incoming Maintenance Contractors.
Responsibility for Maintenance of an asset which is to be renewed shall remain with the Maintenance Contractor throughout unless the proposed renewal Works make such continuing maintenance unsafe or impractical or other specific criteria apply which militate against this.
Responsibility for Maintenance of New or Renewed shall transfer to the Maintenance Contractor from the Project Works Contractor as soon as That asset is Taken into Use by the Employer unless to do so makes such maintenance unsafe or impractical or other specific criteria apply which militate against this. Such transfer shall not remove or diminish the Project Works Contractor's contractual obligations for defect rectification or follow-up work.
The obligations of the Project Works Contractor for maintenance and inspection shall be specified in the Project Works Contract documentation, those of the Maintenance Contractor shall be instructed under this Procedure.
Purpose
To set out the roles, responsibilities and processes for ensuring that responsibilities for Maintenance of New or Renewed Assets, where such renewal takes place outside the scope of a Maintenance Contract, are correctly allocated both during the works and when they are taken into use. It also incorporates measures to safeguard other assets which are adjacent to, and could be affected by, the Works to provide New or Renewed Assets including where such new or renewed assets are not maintained under a Maintenance Contract.
