REISSUANCE AND PURPOSE
This Instruction:
Reissues Reference (a) under the authority of Reference (b).
Establishes policy, assigns responsibilities, and prescribes procedures under References (c) and (d) for Department of Defense (DoD) criminal investigative and law enforcement organizations to report offender criminal history data to the Criminal Justice Information Services (CJIS) Division of the Federal Bureau of Investigation (FBI) for inclusion in National Crime Information Center (NCIC) criminal history databases. This Instruction is not intended to eliminate other requirements to provide criminal history data, including those concerning the Defense Incident Based Reporting System.
Updates procedures to ensure that fingerprint cards and final disposition reports submitted to the CJIS properly reflect the United States Supreme Court's decision that summary courts-martial are not considered judicial proceedings. It is important that users of NCIC databases are informed that findings of "guilty" by summary courts-martial are not equivalent to similar findings by general or special courts-martial.
Updates procedures to extend the requirement to submit, or ensure the submission of, fingerprints and criminal history data pertaining to civilian subjects of investigations in light of the arrest authority granted to civilian agents of the Defense Criminal Investigative Organizations (DCIOs) by Sections 1585(a), 4027, 7480, and 9027 of title 10, United States Code (U.S.C.) (Reference (e)).
APPLICABILITY
This Instruction applies to the Office of the Secretary of Defense, the Military Departments, the Chairman of the Joint Chiefs of Staff, the Combatant Commands, the Office of the Inspector General of the Department of Defense, the Defense Agencies, the DoD Field Activities, and all other organizational entities in the Department of Defense (hereafter referred to collectively as the "DoD Components").
