Purpose
This regulation establishes policies for the administration of a total human resources (HR) program for nonappropriated fund (NAF) employees of the Department of the Army (DA). The policies are based on Section 2105(c), Title 5, United States Code (5 USC 2105(c)) which explains NAF employees are federal employees within the Department of Defense (DOD), and, while not subject to many of the personnel laws administered by the Office of Personnel Management (OPM), NAF employees are included under the laws listed under 5 USC 2105(c)(1). This regulation includes those laws as well as other federal laws, executive orders (EOs), OPM, and DOD policies when NAF employees are specifically included as well as any judicial and administrative interpretation provided by courts and agencies such as the Federal Labor Relations Authority and Equal Employment Opportunity Commission. All such authorities are listed as references.
